    Providers of “high-risk” AI systems in the European Union must appoint an “authorized representative” in the EU. This role functions much like a registered agent in the US, but with additional responsibilities to certify safety and to report wrongdoing.

    Who is required to establish an authorized representative for the EU AI Act?
    Any provider of high-risk AI system that does not have a physical presence already in the EU must appoint an authorized representative.
    What is involved in the process?
    Appointing an authorized representative is quite straightforward. With our preferred partner, we can establish the reslationship formally within a few days. This involves drafting and executing a “written mandate,” which the representative then files with the EU.
    What does an authorized representative actually do?
    The authorized representative has a few responsibilities. They include:
    Receiving correspondence from EU regulatory authorities
    Certifying that the conformity assessment procedure has been carried out correctly
    Registering the company and the product in the EU AI database
    Retaining records
    Replying to requests from EU regulatory authorities, if necessary
    Terminate the representation agreement and inform EU authorities if it believes the client/provider is violating the AI Act
